COURT STRIKES OUT CONTEMPT CHARGE AGAINST CHIEF OMOTUNDE PAUL AS ELEMO ORAYE ISE EKITI

An Ado-Ekiti High Court in the Ado Ekiti Judicial Division has struck out a Contempt of Court charges against Chief Omotunde Paul the Elemo Oraye of Ise Ekiti kingdom.affirming his chieftaincy tittle.

The contempt case instituted by the plaintiffs; Mr. Kayode Oguntuase, Mrs Akinyemi Oguntuase, Mr Ojo Adu Oguntuase, Mr Alaba Adu Oguntuase and the respondents including HRM Oba Ayodele Ajayi Arinjale of Ise Ekiti, Chief Omotunde Paul and Pa. Samuel Ajayi Fapounda was presided over Hon. Justice O.O Olatawura in a suit No: HAD:/933M/2024.

The applicants had filed a motion of comptent against the respondent for alleged neglect to obey the directive contained in the judgment dated July 22, 2024.
Some of the grounds for the application include; Order for Contempt of court resulting from disobedient of court judgment, Judgment in appeal NoCA/EK/100/2021 was delivered on July 2024 with the honourable Court of Appeal holding as follows;
“With the resolution of the two issues for determination in favor of the appeallants, it follows that this is meritorious and it is accordingly allowed. The Judgment of the trial court in suit NO HIS/02/2018 be and is hereby set aside.
“The second respondent has failed to appeal the judgment to the Court of Appeal but continued disobeying the court judgment anong others”
However, justice Olatawura in a ruling delivered on Thursday December 12,2024 declared as follows; “The Court having listened to Olayemi counsel.for the applicant who seek to withdraw this action commenced vide Motion NO: HAD933M/2024 and Orisameji, Counsel for the 1st &2nd respondents not opposing the application, It is hereby order as follows: On the application of Learned Counsel to the applicant to withdraw his motion No: HAD/933M/2024, same is hereby struck out.”
Meanwhile Chief Omotunde Paul remains the Elemo Oraye Ise Ekiti pending the final determination by the Supreme Court.
